This Privacy Policy is entered by The Clientist ("Company," "we," "us," or "our"), and any individual, business entity, visitor, customer, prospect, subscriber, applicant, authorized representative, or other person accessing, browsing, interacting with, or otherwise using Company's websites, landing pages, applications, customer relationship management systems, software platforms, artificial intelligence systems, messaging systems, communication systems, forms, portals, consultations, digital properties, or related services (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and agreed to the terms of this Policy.
Company may collect, receive, generate, process, record, store, organize, analyze, transmit, disclose, or otherwise handle information relating to Users in connection with the provision, operation, maintenance, protection, improvement, enforcement, or lawful administration of the Services.
Information voluntarily submitted by Users may include, without limitation, personally identifiable information, business information, contact information, billing information, operational information, appointment information, onboarding information, support communications, project requirements, implementation data, account credentials, communication preferences, and other information reasonably necessary to facilitate the Services.
Company may automatically collect technical, operational, and analytical information, including, without limitation, Internet Protocol addresses, browser identifiers, operating systems, device identifiers, session information, referral sources, clickstream activity, timestamps, communication logs, system interactions, cookies, analytics identifiers, and related metadata.
Where Users engage Company for business, consulting, implementation, automation, software, artificial intelligence, or operational services, Company may collect business-related information including, without limitation, organizational data, operational workflows, customer databases, pipeline information, communications systems, marketing information, analytics data, technical infrastructure information, and implementation materials.
Company may collect information directly from Users through website submissions, lead forms, scheduling systems, contracts, onboarding systems, support requests, payment systems, customer portals, chat systems, consultations, communications, and other direct interactions.
Company may collect information through cookies, pixels, server logs, tracking technologies, analytics technologies, customer relationship management systems, automation systems, artificial intelligence systems, messaging platforms, and related operational technologies.
Company may receive information from advertising platforms, communications providers, analytics providers, social media platforms, payment processors, scheduling platforms, customer relationship management providers, and other authorized third-party service providers.
Company may use collected information for the purposes of providing, maintaining, securing, improving, optimizing, delivering, supporting, administering, enforcing, monitoring, auditing, analyzing, and otherwise operating the Services.
Company may use collected information to communicate with Users regarding consultations, appointments, onboarding, implementation, billing, support, operational matters, account notifications, customer service matters, updates, service changes, and, where legally permissible, promotional communications.
Company may use information for fraud prevention, abuse detection, identity verification, consent verification, telecommunications compliance, A2P compliance, operational security, legal compliance, dispute resolution, contractual enforcement, and risk mitigation.
Where a User voluntarily provides mobile telephone information or other communications information, Company may create, maintain, retain, and rely upon electronic records evidencing consent, including, without limitation, timestamps, IP addresses, session identifiers, browser data, communication records, opt-in confirmations, opt-out records, delivery confirmations, communication histories, and related compliance records.
Company may send text messages, multimedia messages, automated notifications, support communications, operational notifications, onboarding communications, appointment reminders, billing notifications, service alerts, and, where legally permissible, promotional communications. Message frequency may vary based upon User interactions, account activity, onboarding status, support activity, service activity, communication preferences, and business relationships. Standard message and data rates may apply.
Users may revoke SMS consent at any time by replying "STOP," after which Company shall make commercially reasonable efforts to cease future SMS communications except where operationally necessary or otherwise permitted by law. Users may request assistance by replying "HELP." Consent to receive telecommunications communications is not a condition of purchasing goods or services.
Mobile telephone numbers and SMS consent data collected by Company are used exclusively for the purpose of delivering communications directly from The Clientist to the User who provided consent, including appointment confirmations, appointment reminders, onboarding communications, account notifications, support communications, operational communications, and, where the User has provided separate explicit consent, promotional communications from The Clientist only.
Mobile telephone numbers and SMS opt-in data are never shared with affiliates, marketing partners, advertising networks, data brokers, lead aggregators, or any external entity for the purpose of independent marketing communications. The only third parties with access to such data are infrastructure service providers strictly necessary to deliver the SMS messages themselves (such as telecommunications carriers, messaging aggregators, and our SMS platform provider), and such providers are contractually prohibited from using this data for any purpose other than transmitting Company's authorized communications.
Company may disclose information to service providers, vendors, subcontractors, contractors, infrastructure providers, telecommunications providers, cloud providers, analytics providers, payment processors, communications providers, scheduling providers, and related business partners reasonably necessary for operation of the Services, including, without limitation, Stripe, Google, Zoom, and similar providers. This Section 5.1 does not apply to mobile telephone numbers or SMS opt-in data, the disclosure of which is exclusively governed by Section 4.4 above.
Company may disclose information where reasonably necessary to comply with applicable law, subpoena, court order, arbitration proceeding, regulatory inquiry, governmental demand, fraud investigation, contractual enforcement, or lawful business protection.
Company may disclose or transfer information in connection with mergers, acquisitions, restructurings, financings, asset sales, reorganizations, succession planning, or similar business transactions.
Company implements commercially reasonable administrative, operational, technical, contractual, and organizational safeguards designed to protect collected information from unauthorized access, misuse, alteration, disclosure, destruction, or loss.
Notwithstanding the foregoing, no internet transmission, software platform, telecommunications provider, artificial intelligence system, cloud infrastructure, storage platform, or electronic system can be guaranteed to be entirely secure. Accordingly, Company disclaims any guarantee of absolute security.
Company may retain information for so long as reasonably necessary to provide the Services, maintain business records, preserve consent records, maintain A2P compliance records, enforce agreements, resolve disputes, comply with legal obligations, protect legitimate business interests, and otherwise operate the Services. Retention periods may vary depending upon the nature of the information involved.
To the extent applicable under the laws of the State of California, eligible residents may possess certain statutory rights concerning access, correction, deletion, or disclosure of certain personal information, subject to lawful exceptions. Company reserves the right to verify identity prior to processing any such request.
The Services are intended exclusively for business and professional use and are not directed toward individuals under eighteen (18) years of age. Company does not knowingly collect personal information from children.
Company reserves the right, in its sole discretion, to modify, amend, supplement, or replace this Policy at any time. Any updated version shall become effective upon publication unless otherwise required by law. Continued use of the Services constitutes acceptance of such modifications.
